Ban questions regarding past pay rates?

Earlier this month, the New York City Council approved legislation that will ban employers from asking job applicants about their current or past pay rates.

The bill will also prohibit employers from asking a candidate's current or former employers about pay rates or searching public records for them. Job-seekers can, however, provide such information if they choose.

Similar measures have been passed in Massachusetts, Puerto Rico and Philadelphia with close to 20 states and some cities considering it.

At the federal level, the recently reintroduced Paycheck Fairness Act proposes to ban the question during job interviews. So does a bill that is being reintroduced from 2016 by Rep. Eleanor Holmes Norton (D-D.C.).

Currently, there is no such legislation proposed in NH.

Supporters of such legislation contend that it helps to promote pay equity and effectively puts an end to pay discrimination practices that individuals may have previously faced.

Opponents, however, argue that many employers have already adopted such measures on their own. They further argue that the government should have no role in the relationship between an employer and potential employee.
