NH will not join bathroom lawsuit

Earlier this year President Obama announced that schools must allow students to use bathrooms that correspond with their gender identity or risk losing federal funding.

Now twenty-one states are suing the federal government over this rule.  New Hampshire’s Attorney General is not going to join the lawsuit, however.

Legislators may sponsor a bill to compel the Attorney General to sue the federal government, but the legislature won’t take up any new bills until January 2017.

Supporters of Obama’s ruling argue that it protects the civil rights of students. 

“While the Obama administration is being sued, the real targets here are vulnerable young people and adults who simply seek to live their lives free from discrimination when they go to school, work or the restroom,” said James Esseks, director of the ACLU LGBT Project. 

Opponents argue that Obama’s directive threatens privacy.  They also argue that the administration is overstepping its legal bounds by using a law against sex discrimination to cover transgender issues.
